The judge can still place the offender on the registry if they feel it's appropriate. This just gives them the choice they feel it's inappropriate.

With Newsom and the most liberal senator Kamala Harris that law will go nation wide. Yes Anti how do you feel about a 24 year old with a 14 year old. They are just testing their limits the age gap will become larger.

Best I can tell, SB 145 "gives trial judges discretion to place a person on the Registry if the offender - a legal adult at the time of the offense - engaged in certain "non-forcible" sexual acts with a minor - fourteen years of age or older and within ten years of age from the adult offender."


The law already gave that power to judges when it was v*ginal sex, but if it was anal or oral then the court had no such discretion and the defendant was automatically on the sex registry. This just changes it so that anal and oral sex is treated the same way.

For example... in California, if a 19 year old boy had sex with his 17 year old girlfriend, the judge could decide that he should not be on the registry. But if a 19 year old boy had sex with his 17 year old boyfriend, he would automatically be put on the registry.
